Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GroundStop.app website at www.groundstop.app, its dashboard, map, API, email alerts, webhooks and any related features (together, the "Service"), operated by GroundStop.app ("GroundStop.app", "we", "us" or "our").

By accessing or using the Service, creating an account, or using an API key, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Important: GroundStop.app is an independent, unofficial information service. It is not affiliated with, endorsed by, or operated by the Federal Aviation Administration (FAA), the National Oceanic and Atmospheric Administration (NOAA), the National Weather Service, any airline, or any airport. Information may be delayed, incomplete or wrong. Never use the Service for flight planning, navigation, dispatch, air traffic or any safety-of-life decision. Always confirm with official sources.

Section 16 contains a binding arbitration agreement and class action waiver that affect your legal rights. Please read it carefully.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it, and "you" includes that organization.

2. Informational use only; no reliance

The Service republishes and summarizes publicly available information, including the FAA's National Airspace System status feeds, and displays third-party weather radar imagery. It is provided for general informational purposes only.

  • The Service is not an official source of air traffic, flight status, airport, or weather information, and is not a substitute for official FAA, NOAA/NWS, airline or airport communications.
  • Ground stops, delay programs, projections and other data may be delayed, missing, misparsed, out of date, or wrong. Projections reflect FAA planning information and may never occur.
  • AI-generated summaries are produced automatically by a third-party language model and may be inaccurate or misleading.
  • Weather radar imagery comes from third parties, may be delayed or incomplete, and is not suitable for weather avoidance or any operational purpose.
  • Map boundaries (including ARTCC boundaries) and airport locations are approximate.

You are solely responsible for how you use information from the Service, including any travel, business, operational, financial or safety decision. You agree not to rely on the Service for any purpose where an error, delay or outage could cause injury, death, property damage, or financial loss.

3. Accounts

Some features require an account. You agree to provide accurate information, keep your password and API keys confidential, and notify us at support@groundstop.app of any unauthorized use. You are responsible for all activity under your account and API keys. We may refuse registration, or limit the number of webhooks, alerts or API keys per account, at our discretion.

4. Email alerts and webhooks

  • Alerts are best-effort. We do not guarantee that any alert will be sent, delivered, delivered on time, or delivered only once, or that an alert reflects every change. Delivery depends on third parties (including email providers and your endpoints) outside our control.
  • You are responsible for any URL you register as a webhook, for securing it, and for verifying signatures. You must only register endpoints you own or are authorized to use. We may pause or remove webhooks that fail repeatedly or that we believe are being misused.
  • Email alerts are sent only to a confirmed address. You can unsubscribe at any time using the link in any alert email or in your account.

5. API

  • API access requires a key and is for your own personal or internal use. Keys are confidential and may not be shared, sold or published.
  • We may set, change or enforce rate limits and usage limits, and may suspend or revoke keys at any time, with or without notice, including for excessive use or any breach of these Terms.
  • You may not resell, sublicense, or offer the Service or its data as a standalone or competing service, or represent that data from the Service is official, without our prior written permission.
  • The API may change or be discontinued at any time.

6. Acceptable use

You agree not to, and not to help anyone else to:

  • violate any law or regulation, or anyone's rights;
  • access the Service by automated means other than the documented API (including scraping the website), or exceed or circumvent any rate limit, access control or security measure;
  • probe, scan or test the vulnerability of the Service, or interfere with or disrupt it, its infrastructure, or other users;
  • use webhooks or alerts to send spam or to target systems you are not authorized to send requests to;
  • upload or transmit malware or harmful code;
  • reverse engineer the Service except where the law expressly allows it despite this restriction;
  • impersonate any person or entity, or misrepresent your affiliation with the Service or any government agency;
  • create accounts by automated means or under false pretenses, or create multiple accounts to evade limits or a suspension.

7. Intellectual property

The Service, including its software, design, text, graphics, maps, logos and the GroundStop.app name, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. All rights not expressly granted are reserved.

Underlying public data (such as FAA status information) and third-party content (such as radar imagery and map data) belong to their respective owners and are subject to their terms. Attributions appear in the Service where required.

8. Feedback

If you send us ideas, suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose without obligation or compensation to you.

9. Third-party services

The Service relies on and may link to third-party services (for example hosting, database, email delivery, analytics, AI and weather data providers). We do not control and are not responsible for third-party services, their availability, content or practices, and your use of them may be subject to their own terms.

10. Fees

The Service is currently free. We may introduce paid features or plans in the future; if we do, we will tell you the price and terms before you are charged, and you will not be charged without agreeing to them.

11. Changes, availability and termination

We may change, suspend or discontinue all or part of the Service at any time, with or without notice, and without liability to you. The Service may be unavailable, interrupted or delayed at any time, including for maintenance or because of third-party outages.

We may suspend or terminate your access, account, alerts or API keys at any time, for any reason, including if we believe you have violated these Terms. You may stop using the Service at any time and may ask us to delete your account by emailing support@groundstop.app. Sections that by their nature should survive termination (including 2, 7, 8 and 12–18) will survive.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service and all information, data, alerts, summaries, maps and imagery are provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, availability, or that the Service will be uninterrupted, secure or error-free, or that alerts will be delivered. No advice or information obtained from the Service creates any warranty not expressly stated in these Terms.

13. Limitation of liability

To the fullest extent permitted by law, in no event will GroundStop.app or its owners, operators, affiliates, contributors, licensors or service providers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, or for any missed, delayed or cancelled flight, travel cost, personal injury, or property damage, arising out of or relating to the Service or these Terms, whether based on contract, tort (including negligence), strict liability or any other theory, even if advised of the possibility of such damages.

Our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.

14. Indemnification

You agree to defend, indemnify and hold harmless GroundStop.app and its owners, operators, affiliates, contributors and service providers from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your webhooks, endpoints or integrations, any content you submit, your violation of these Terms, or your violation of any law or third-party right.

15. Governing law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to Section 16, the exclusive venue for any dispute is the state and federal courts located in the State of Texas, and you and we consent to their personal jurisdiction.

16. Dispute resolution; arbitration; class action waiver

Informal resolution. Before bringing a claim, you agree to contact us at support@groundstop.app and try in good faith to resolve the dispute informally for at least 30 days.

Binding arbitration. Except for the exceptions below, any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English, in the State of Texas or by video conference. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.

Class action waiver. You and we may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court to protect intellectual property or to stop misuse of the Service.

Opt-out. You may opt out of this arbitration agreement by emailing support@groundstop.app within 30 days of first accepting these Terms, with your name, account email and a clear statement that you opt out of arbitration.

Time limit. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.

17. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here and change the "Last updated" date; for material changes we may also notify you by email or in the Service. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect means you accept them.

18. General

  • These Terms and the Privacy Policy are the entire agreement between you and us about the Service and supersede any prior agreements.
  • If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in effect.
  • Our failure to enforce any provision is not a waiver of it.
  • You may not assign or transfer these Terms without our consent; we may assign them, including in connection with a merger, acquisition or sale of assets.
  • We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of data sources or service providers, internet failures, or acts of government.
  • No agency, partnership, joint venture or employment relationship is created by these Terms.
